This License Agreement (hereinafter Agreement) is a legal agreement between you (either an individual or a single entity) and Phpmagicscripts company, privately-held software development company, for the purchased software product, including any software, media, and accompanying on-line or printed documentation ("Product"). If you are not agree with one of the points of the Agreement you may not use the Product.
BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THE LICENSE AGREEMENT. GRANT OF LICENSE Provided that you agree to all terms and conditions of this agreement, Phpmagicscripts company grants you a nonexclusive license including the following rights: You may install and use one copy of the Product within ONE (1) installation per domain. Additional copies of the Product may be installed and used, up to the number of "Licensed Copies" purchased. Incorporation of the Product into your website, modification of the Product's source-code and incorporation of the modified source-code into your software, within the limits of the number of "Licenced Copies" purchased. You may make copies of the Product for backup and archival purposes. Phpmagicscripts company reserves all rights not expressly granted to you in this agreement. RESTRICTIONS Unless you have been granted prior, written consent from Phpmagicscripts company, you may not: reproduce, distribute, or transfer the product, or portions thereof, to any third party. You may not rent or lease the Product or grant rights to any other person. DISCLAIMER OF WARRANTY THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. FURTHER, Phpmagicscripts company DOES NOT WARRANT THAT THE SOFTWARE OR ANY RELATED SERVICE WILL ALWAYS BE AVAILABLE. REFUNDS Refunds are issued at the discretion of the company management within 30-days period after date of purchase. In your claim, please, include explanation of reasons for a refund, and your order information. Prior to ordering, please, make sure you have carefully read and understood the product's system requirements. If you are not sure about product compatibility, or have questions about product features, please contact our Client Support Service. All inquiries are free of charge. Upon confirmation of your request for a refund, you must also destroy all copies of the software you may have made or stored in any place, as well as uninstall the software from any computers owned or controlled by you where you have installed the software. All licenses you may have to use the software will be immediately terminated, and any further use of the software will be an infringement of copyrights as well as other intellectual property rights. No refunds are issued for provided services (including product installation, customization and software development) if provided services meet predefined specifications. LICENSE LIMITATIONS Each product license is issued based on domain, where it will be used. If you need this product working on additional domains you need to purchase separate licenses. LIMITATION OF LIABILITY Neither party shall be liable for any indirect, incidental, special, punitive, or consequential damages, or any loss of profits, revenue, data, or data use. Our maximum liability for any damages whether in contract or tort will not exceed the fees which you have paid to us or are payable to us for this order. TERMINATION The license is effective until terminated. You may terminate it at any other time by deleting the Software together with all copies, modifications and merged portions in any form. It will also terminate upon conditions set forth elsewhere in this Agreement or if you fail to comply with any term or condition of this Agreement. You agree upon such termination to delete the Software together with all copies, modifications and merged portions in any form. Policy Changes Phpmagicscripts Co. reserves the right to modify this Refund Policy at its discretion, or against any customer it believes is abusing this policy. Any such revision or change will be binding and effective immediately after posting of the revised Refund Policy on Phpmagicscripts Co. websites. You agree to periodically review our websites, including the current version of our Refund Policy. Our refund policy is made available on our websites. It is your obligation to review our refund policy for any such revisions. GENERAL If any provision of this Agreement is declared void or unenforceable by any judicial authority, this shall not nullify the remaining provisions of the Agreement which shall remain in full force and effect. You may not sublicense, assign or transfer the license or the Software except as expressly provided in this Agreement. Any attempt to otherwise sublicense, assign or transfer any of the rights, duties or obligations hereunder is null and void. |
